Sir David Martin Foundation appreciates the support it receives from individuals, organisations and the greater community.
These terms and conditions apply to organisations, groups and individuals (you or your) who are planning to fundraise on behalf of Sir David Martin Foundation. By submitting your Application for Authority to Fundraise (Application), you agree to comply with and to be bound by these terms and conditions. Terms and conditions
- Sir David Martin Foundation encourages and appreciates fundraising activities being undertaken by members of the community for our benefit. Fundraising may be done through an event or other activity referred to as Community Fundraising. All events and community fundraising activities must be approved by us in advance of the event or activity occurring.
- You must apply to Sir David Martin Foundation for an Authority to Fundraise, before you begin any fundraising on our behalf.
- You must receive our Letter of Authority before you begin your fundraising. You may fundraise during the approved dates and approved event or activity as specified in the Letter of Authority.
- If you wish to extend or change any aspect of your fundraising event or activity you will need to seek additional approval from us. Sir David Martin Foundation may issue a new Letter of Authority or revoke approval of the fundraising activity.
- You must ensure that the event or activity is run in accordance with all relevant legislation and regulations in the state or territory which the fundraising activity is being held, and you are responsible for obtaining any permits, authorities, licenses and insurances needed.
- In conducting your fundraising activity or event you are responsible for the safety of the participants, volunteers and personnel involved in the activity or event, including organising appropriate public liability insurance and providing first aid services if required. Sir David Martin Foundation accepts no responsibility for any accidents or incidents during the planning, organisation or running of the approved fundraising activity.
- Sir David Martin Foundation does not provide public liability insurance for fundraising activities conducted by third parties.
- Any use of Sir David Martin Foundation’s logo, text, images, name or any other branding must first be approved by us.
- Any public promotion such as corporate presentations, social media campaigns and posts, and media advertisements need to be approved by the foundation prior to commencement.
- All publicity in reference to the fundraising event/activity should clearly state that the event / activity is being organised by you. All promotional material must be worded in such a way as to make it clear that Sir David Martin Foundation is either the only beneficiary or is one of a number of charities benefiting from the event.
- You must make it clear in any dealings with the public, donors, sponsors and supporters that you are not our agent or representative but are acting on your own behalf to raise money for Sir David Martin Foundation.
- Where feasible, you agree to use a fundraising platform designated by Sir David Martin Foundation for your fundraising activities and for the collection of donations.
- Where cash is collected at an event (e.g. sale of raffle tickets) you agree to deposit the funds directly into Sir David Martin Foundation’s nominated bank account as soon as is practical and no later than 3 business days after collection. We reserve the right to ask you to produce records of funds collected and any expenditure.
- You must not hold funds raised for us in your personal bank account at any time.
- All costs and debts associated with your fundraising activity or event are your responsibility and we will not be liable for any financial loss suffered by you or other parties involved in your activity.
- You acknowledge that Sir David Martin Foundation has the sole discretionary right to allocate any funds raised and donated by you to us.
- The organiser agrees to release Sir David Martin Foundation to the fullest extent permissible under law for all claims and demands of any kind associated with the fundraising activity / event, and to indemnify Sir David Martin Foundation for all liability or costs that may arise in respect to any damage, loss or injury occurring to any person in any way associated with the fundraising activity / event.
- We may at any time without the need to give any reasons, withdraw your approval to fundraise by notification in writing.
